1. Acceptance of Terms
By downloading, installing, or using the Open Learning Lab application ("App") or visiting our website at openlearninglabs.com ("Website"), you agree to be bound by these Terms of Service. If you are a parent or guardian agreeing on behalf of a minor, you represent that you have the authority to bind them to these terms. If you do not agree, please do not use our services.
2. Description of Service
Open Learning Lab is an educational iOS application designed for children ages 6–9 that provides interactive math learning through adventure games, mini-games, and adaptive practice. The App includes free content and optional paid subscriptions that unlock additional features, skills, and customisation options.
3. Subscriptions & Payments
Subscriptions are billed through your Apple ID account via the App Store. Available tiers include Explorer ($4.99/month or $39.99/year), Champion ($7.99/month or $59.99/year), and Family ($11.99/month or $89.99/year). Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in your Apple ID account settings. Refunds are handled by Apple according to their refund policy.
4. Intellectual Property
All content in the App and on the Website — including but not limited to text, graphics, logos, characters (Ava, Hannah, Kitty, and all pet companions), illustrations, animations, audio, video, software, and curriculum content — is the property of Open Learning Lab and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without our express written permission.
5. Acceptable Use
You agree to use the App and Website only for their intended educational purpose. You may not: (a) attempt to reverse-engineer, decompile, or disassemble the App; (b) use the App for any commercial purpose without our consent; (c) share subscription access with individuals outside your household; (d) attempt to circumvent any security or access controls; or (e) use the services in any way that violates applicable law.
6. Disclaimer of Warranties
The App and Website are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components. Educational content is designed to supplement, not replace, formal schooling.
7. Limitation of Liability
To the maximum extent permitted by law, Open Learning Lab and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damages arising from your use or inability to use the App or Website. Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
8. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Material changes will be communicated by updating the "Last updated" date on this page. Your continued use of the App or Website after such changes constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Texas, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Texas.
